WAVE Cycle Terms + Conditions

Please read these Terms and Conditions carefully, as they contain important information regarding your legal rights, remedies, and obligations and in using this website you are deemed to have read and agreed to the following Terms and Conditions.

Use of the Site by Minors

If you are under 18, you may register and use the Website and App only with the involvement of a parent or guardian. WAVE does not accept the online registration of minors; please do not attempt to register on the Website or App if you are under the age of 18. Registration of a minor is permitted for WAVE Cycle classes only, and must be completed in person at one of our studios with a parent or guardian. Minors who are at least 16 years of age, meet the minimum height requirement of 4’11”, who have submitted a Minor New Rider Waiver Form signed by a parent or guardian, may sign up for WAVE Cycle classes online.

Reservations

In order to make a reservation, you must first buy a single class or a series of classes. To buy an individual class or series of classes online, you can either sign up by using your e-mail and creating a password, or if you are already registered, click login to buy a series and make your reservation. You can reserve classes online up to 1 week in advance (Sunday at noon through the following Sunday), but not later than 1 hour prior to class time. You may book up to five (5) bikes per account in a 45-minute WAVE Class. Reach out to the WAVE studio to ask about advanced group booking options. WAVE reserves the right to hold up to ten (10) bikes and/or spots in each class.

 

Cancellation Policy for Reservations

In order to cancel a reservation in a WAVE Cycle class and return it to your account, you must unreserve by 6 PM the night prior to the class. Once your reservation is cancelled, the class will be returned to your account to be used at a future date; the class is not refunded. If you haven’t cancelled by 6 PM the night before, your scheduled class will be charged to your series. Please note, however, that this cancellation provision is only for Classes.

You can cancel your reservation in the following ways:

Log into your account on the Website or the App, and, next to the class you wish to cancel, press “unreserve”.

Call the studio where you’re booked to cancel the class for you.

Please note, in fairness to all our customers, BIKES AND SPOTS WILL BE RELEASED 4 MINUTES BEFORE CLASS BEGINS. In the event that you do not unreserve your bike by 6 PM the night prior to class, or if you do not claim your bike at least 4 minutes before class begins, then WAVEE Cycle shall have the right, without any credit or refund to you, to allow others to reserve or use your bike for a fee.

FOR RIDERS AND COMMUNITY MEMBERS RUNNING LATE: We ask that you call the studio to let us know you are on the way. If you call the front desk at least 4 minutes before class begins, we will hold a reservation for up to 10 minutes after class begins, though we cannot guarantee you will be given the bike you signed up for in WAVE Cycle classes. Riders and community members who are more than 10 minutes late will not be admitted into class, as it is too disruptive.

FOR RIDERS AND COMMUNITY MEMBERS LEAVING EARLY: If you’re planning on leaving early, we kindly request that you tell the instructor ahead of time.

You MUST SIGN IN next to your name upon arrival. If you do not sign in, we may release your bike to another guest 4 minutes before the start of class. DO NOT ASSUME THE FRONT DESK STAFF KNOWS YOU ARE IN ATTENDANCE. Additionally, signing in for other clients is prohibited.

Waitlist Policy

If you book multiple classes or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy. WAVE Cycle staff cannot be held responsible for accidental bookings by clients or double bookings or double waitlisted classes made by clients. Late cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy for double bookings.

The system will auto-populate clients into class from the waitlist as other clients with confirmed spots cancel and bikes will be assigned as such.

WAVE Cycle staff will add walk-in, waitlisted clients in the order in which they were added to the waitlist by the computer system, top to bottom, and EXACTLY 4 minutes before the start of class. There is no waitlist priority given for early arrival.

Height Requirement
Riders must be 4’11” at minimum to participate in classes at WAVE Cycle.

What to Expect in Classes at WAVE Cycle
WAVE Cycle conducts high intensity, choreographed, cardio classes on a stationary bicycle. Classes are choreographed for all Levels. Music will be played which may contain explicit language. If you have an injury are sensitive to heat or explicit music, please check with our front desk staff to find the right instructor to meet your needs. Be aware that riding an indoor cycle with little to no resistance can be harmful and result in injury. Please keep one to two full turns of resistance on the bike at all times.  For more information on safety, please talk to a member of the WAVE Cycle front desk staff or instructor.

Merchandise Return Policy 

Please follow some of our helpful guidelines for making a return below!

IN-STUDIO PURCHASES:

Items must be returned within 30 days of purchase, unwashed and unworn with tags still on.

Items must be returned to the WAVE CYCLE studio.

If you purchased your item under your WAVE CYCLE account, a staff member can easily look it up in your purchase history!

If you do not have a WAVE CYCLE account and checked out as guest, you must have the full receipt present when making your return.

Was this item a gift? You can still return! We just need the full receipt to issue the return.

Upon return, you will receive a store credit on your account that can be used for anything at WAVE (classes, retail, etc.). Our store credit can only be accessed via the backend, so always let a member of the WAVE CYCLE team know to pull from your credit whenever you want to make a purchase, or if you have any questions about how much store credit is remaining.

Exchanges for merchandise/store credit can only be made in the country of purchase.

When you visit WAVE Cycle or send emails to us, you are communicating with us electronically, and therefore consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Gift Certificate and Gift Cards

In addition to classes and series of classes, you can also buy a gift certificate. WAVE’s gift certificates are called “gift cards”. Gift cards never expire and the person that you are giving them to can use his or her gift card(s) to buy classes or to buy any kind of merchandise. Once a class is purchased using a gift card, it will expire, just like any other class you buy.

Gift cards and classes are not the same thing. Unlike gift cards or gift certificates, classes are for our rides/classes only. You cannot give classes to another as a gift. When you buy a class, you are only entitled to use that class to book a bike in a particular studio at a particular time. You cannot redeem your class for cash and you cannot transfer it to another rider or community member.

Classes do expire. The expiration dates are posted in the description of the class or series of classes on the Website. If, however, you get jammed up and cannot book a ride/class in time, just give us a call, stop by the studio, or e-mail us and we can help you.

Future class prices are subject to change, but WAVE will honor your class or series of classes until the expiration date, regardless of whether there is a price increase in the interim. We accept MasterCard, Visa, Discover, and American Express. Cash payments may only be made in a WAVE studio. You can reserve classes online up to 1 week in advance (Sunday at noon through the following Sunday), but not later than 1 hour prior to class time.

Your credit/debit card will be charged for your order when you buy your class or series of classes, not when you book your bike. WAVE Cycle will not process charges that use an incorrect, expired, or over-the-limit credit card. We will try to contact you if this occurs. If you fail to pay any fees or charges when due, services or privileges may be suspended or terminated. You shall be responsible and liable for any fees, including attorneys’ fees and collection costs, that WAVE Cycle may incur in its efforts to collect any unpaid balances from you.

Consumer’s Right to Cancellation

WAVE CYCLE has a no refund policy on individual classes and any of our series of classes.

Intellectual Property Rights
“WAVE Cycle, LLC”, “WAVE Cycle”, and the wheel wave logo and other graphics, logos, designs, page headers, button icons, scripts are service marks, trademarks, and/or trade dress of WAVE Cycle, LLC dba WAVE Cycle and may not be used by you for any other reason other than as expressly permitted by these terms. You have the right to view, electronically copy, and print in hard copy portions of this Website for the sole purpose of making class reservations or other personal use. Any other use of the materials on this Website without the prior written permission of WAVE Cycle, LLC dba WAVE Cycle is strictly prohibited.

Choice of Law of this Website, and your use hereof, is governed by the laws of the State of Rhode Island, without regard to Rhode Island’s choice of law provisions, and any claim arising from your use of this website must be brought in Rhode Island.
WAVE Cycle, LLC dba WAVE Cycle may revise these terms and conditions by updating this posting. By using this Website, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms and Conditions to which you are bound.

WAVE CYCLE Conditions, Assumption of Risk, Waiver, and Release Agreement

By signing up for and/or attending classes, events, activities, and other programs and using the. premises, facilities and equipment, or any other location or venue where WAVE Cycle is providing services (individually and/or collectively, the “Classes and Facilities”) of WAVE Cycle, LLC and its subsidiaries (collectively “WAVE Cycle”),  thereby acknowledge on behalf of myself, my heirs, and person representatives and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and Facilities. I acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. I also acknowledge that specific risks vary from one activity to another, but range from (minor injuries such as scrapes, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries in eluding paralysis and death. At all times, I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to me by staff. If in the subjective opinion of WAVE Cycle staff, I would be at physical risk participating in WAVE Cycle’s Classes, I understand and agree that I may be denied access to the Classes and Facilities until I furnished WAVE Cycle with an opinion letter from my medical doctor, at my sole cost and expense, specifically addressing WAVE Cycle’s concerns and stating that WAVE Cycle’s concerns are unfounded. In consideration of being allowed to participate in and access the Classes and Facilities, I hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by me in relation to the Classes and Facilities, (2) release, indemnify, and hold harmless WAVE Cycle, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related tp participation in the Classes or use of Facilities, and (3) represent that I (a) have no medical or physical condition that would prevent me from properly using any of WAVE Cycle’s Classes and Facilities, (b) do not have a physical or mental condition that would put me in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. I acknowledge that if I have any chronic disabilities or conditions, I am at risk in using WAVE Cycle’s Classes and Facilities, and should not be participating in any Classes.

I have read this WAVE CYCLE Conditions, Assumption of Risk, Waiver, and Release Agreement, fully understand its terms, and understand that I am giving up substantial rights including my right to sue WAVE Cycle under certain circumstances. I acknowledge that I am signing this waiver freely and voluntarily. The term of this waiver is indefinite.

VALUABLES AND PERSONAL PROPERTY: I acknowledge that I have been urged to avoid bringing valuables onto the Facilities and that WAVE Cycle shall not be liable for the loss of, theft of, or damage to my personal property, including items left in lockers, bathrooms, studios, or anywhere else in the Facilities. I acknowledge that no portion of any fees paid by me is in consideration for the safeguarding of valuables.

Etiquette: to preserve the WAVE Cycle sanctuary, I agree to abide by WAVE Cycle’s etiquette guidelines found on WAVE Cycle’s posted signs. WAVE Cycle reserves the right to deny access to any person WAVE Cycle deems to be acting in an inappropriate or unsafe manner.
